Terms of Service

Welcome to Get2Getha! By accessing or using our mobile application ("App") or website ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use our services.

1. Who We Are

Get2Getha is a social coordination platform that helps users create, join, and manage in-person events and gatherings. We provide tools for communication, discovery, and location sharing to facilitate meetups.

2. Eligibility

  • You must be at least 16 years old to use the App. If you are under 18, you must have parental or guardian consent
  • By using the App, you represent and warrant that you meet these requirements

3. Account & User Responsibilities

  • You must provide accurate, complete, and up-to-date information when creating an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You may not use another person's account without authorization

Prohibited Conduct

You agree that you will not, directly or indirectly:

  • Use the App for unlawful, harmful, or misleading purposes
  • Engage in or promote harassment, hate speech, discrimination, or violence
  • Upload or distribute content that infringes intellectual property, privacy, or other rights
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code from the App
  • Interfere with or disrupt the operation of the App (including bypassing security measures, using bots, or scraping data)
  • Use the App in connection with fraud, scams, or other illegal activity

4. Location Data & Permissions

  • The App may collect and use your device's location in the background for features such as check-ins, event discovery, and safety
  • By enabling location services, you consent to this usage in accordance with our Privacy Policy

5. User Content

  • You may post content (e.g., messages, images) while using the App
  • You retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, display, and distribute it as necessary to operate and improve the App
  • You agree not to post anything unlawful, abusive, defamatory, obscene, or otherwise objectionable
  • We reserve the right (but are not obligated) to remove or restrict content that violates these Terms

6. Public and Nearby Events

  • Events marked as "Public" or "Nearby" may be visible to other users based on distance or Bluetooth proximity
  • You understand and accept the risks associated with joining or hosting real-world events

7. Safety & Disclaimers

  • We are not responsible for the behavior, actions, or safety of users at events
  • You are solely responsible for your safety and conduct during meetups
  • Use common sense and caution when interacting with others or attending events

8. Termination

We may suspend or terminate your account, with or without notice, if you:

  • Violate these Terms
  • Engage in unlawful, harmful, or disruptive behavior
  • Misuse the App in a manner that threatens the safety, integrity, or rights of others

9. Intellectual Property

  • All rights, title, and interest in and to the App (including software, trademarks, and content created by us) remain the property of Get2Getha LLC and its licensors
  • Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from any part of the App

10. Limitation of Liability

To the fullest extent permitted by law:

  • Get2Getha shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App or participation in events
  • We do not guarantee the availability, safety, or accuracy of any event or user

11. Governing Law

  • These Terms are governed by the laws of North Carolina and the United States of America, without regard to conflict of law principles

12. Dispute Resolution & Arbitration

  • Informal Resolution: Before filing a claim, you agree to first contact us at support@get2getha.com to attempt to resolve the dispute informally
  • Binding Arbitration: If a dispute cannot be resolved informally, you agree that it will be settled through binding arbitration, conducted by a recognized arbitration body under its applicable rules
  • Class Action Waiver: You agree that disputes will be resolved only on an individual basis, and not in a class, collective, or representative action
  • Exceptions: Either party may bring a claim in small claims court, or seek injunctive or equitable relief for intellectual property infringement or misuse without arbitration
  • Governing Law: Any arbitration will take place in North Carolina, and North Carolina law will apply

14. Data Collection and Usage

By using Get2Getha, you acknowledge and agree that we may collect and process certain types of data, including:

  • Personal Information (phone number, username, email, Firebase UID)
  • Location Data (background and foreground)
  • Bluetooth Signals (for proximity-based features)
  • Event Participation and Interaction Logs
  • Device Data (app version, crash logs, platform, device model, OS version)

This data helps us operate and improve the App. See our Privacy Policy for full details. You can revoke location and Bluetooth permissions via your device settings.
